PUNE: An additional sessions court granted ad interim anticipatory bail till August 12 to four Shiv Sena men including former PMC corporator Vishal Dhanawade, Pune district president Gajanan alias Vinayak Tharkude and two party workers booked in connection with the attack on former minister and rebel Sena MLA Uday Samant’s sports utility vehicle at Katraj Chowk on the night of August 2.
The Sena men moved the court for seeking anticipatory bail fearing arrest after the Bharati Vidyapeeth police arrested six party workers on August 3.
The judge in its order said, “The immediate custody of the applicants Dhanawade, Tharkude, Aniket Ghule and Rupesh Pawar was not essential. For assessing their exact role, police papers and report needs to be perused. Till then the applicants needs to be protected.”
The court said the applicants in the event of their arrest should be released on ad interim bail on executing personal bond and surety bond of Rs 30,000 each of the like amount.
The Sena men were directed to make themselves available for questioning whenever called by the investigation officer and give attendance at the police station on Friday and Saturday between 11am and 2pm. They were warned not to leave the jurisdiction of the court.
The court has issued notices to the police to respond to the bail pleas by August 12.
Lawyers Vijay Thombare and Hrishikesh Subhedar told the court the Sena men has been named in the FIR but their individual role in the crime was not described.
The lawyers argued that charges relating to attempted murder, attacking public servant and voluntary causing hurt to deter public servant from discharging duty under sections 307, 353 and 332 of the Indian Penal Code was wrongly invoked in the case.
